OSKALOOSA —
The trial of a man accused of using an ax to murder his mother’s boyfriend will be delayed about one month.
The Mahaska County Attorney’s Office had charged Bradley William Arterburn, 27 of Oskaloosa, with first-degree murder.
The trial had been scheduled for last year, but a series of “continuances” pushed it to this August. On Tuesday, the court moved the scheduled date to 9:30 a.m. on Sept. 18.
The charge stems from the June 2011 death of Robert Henry Horovitz, 58, of Davenport. Arterburn entered a plea of not guilty in Mahaska County Court July 12, 2011.
Oskaloosa police allege Arterburn used a “medieval-style” double-edged battle axe in the attack on Horovitz.
In September, the Public Defender’s Office, which is representing Arterburn, filed a Rule 2.11(11) request, which covers several specific but separate defenses including “insanity and other diminished responsibility ...”
In February of this year, the judge ordered a psychiatric examination of the defendant. After that time, however, the judge ruled that the case could go to trial.
