Appanoose County man negotiates probation

CENTERVILLE — An Appanoose County man negotiates a plea deal and in return a judge agrees with the county attorney and suspends his prison sentence for probation.

Matthew Lee Dakin, 42, of Moravia, was charged with one count of assault with intent to commit sex abuse, no injury and one count of child endangerment, both aggravated misdemeanors and both with an offense date of Sept. 1, 2011.

On March 30, 2012, Dakin filed a wavier of rights and a guilty plea for the aggravated misdemeanor charge of child endangerment. The wavier states Appanoose County Attorney Richard Scott would recommend a fine, two years in prison, suspended, defendant placed on two years probation with the Department of Corrections and the charge of assault with intent to commit sex abuse, no injury, would be dismissed.

On March 30 in the Appanoose County courtroom Judge Kirk A. Daily accepted Dakin's voluntary, negotiated guilty plea to the child endangerment charge and sentenced him to what the county attorney had recommended.

According to the criminal complaint filed Nov. 1, 2011 by Appanoose County Sheriff Deputy Keith Glosser, the defendant made sexual physical contact with a minor female during the Labor Day weekend at his residence in Moravia.

A no-contact order was issued against Dakin protecting the minor female on Nov. 1, 2011.

Dakin owes the state $1,165.75.
